The information below is intended to help families understand the general legal position when making arrangements after pregnancy loss.
Definitions and stillbirths
The 26-week threshold: Under South African law, official death notification forms and birth or death certificates are issued for live births, or for stillbirths occurring at 26 weeks or more of gestational age.
Pre-viable foetuses: A pregnancy loss or termination at 24 weeks is classified as pre-viable under the Births and Deaths Registration Act and falls outside its formal registration framework.
Burial and disposal
Constitutional Court ruling: The Court confirmed that the Act does not regulate the burial of pre-viable foetal remains. It therefore neither permits nor prohibits burial or cremation under that Act.
Standard hospital practice: Hospitals commonly manage losses before 26 weeks under medical-waste and disposal guidelines unless parents request and arrange a private burial or cremation option that the health facility permits.
